In addition to the foregoing, when you use the StubHub ticket resale marketplace and services (the "StubHub Marketplace"), you will be bound to the terms of the User Agreement and Privacy Policy applicable to the StubHub.com website (the "StubHub Website") and the StubHub Marketplace. StubHub is the official online secondary ticketing provider for MLB.com and the Cubs. You are encouraged to read all applicable Terms of Use, User Agreements and Privacy Policies before you engage in any transaction on My Cubs Tickets and/or the StubHub Marketplace. By engaging in a transaction on My Cubs Tickets, you agree to use the Services subject to and in accordance with the following terms and conditions and, where applicable, you represent the same to be true:

1. Eligibility and Registration. If you wish to list a Ticket from your My Cubs Tickets account to sell such Ticket on the StubHub Marketplace, to use the Forward function of My Cubs Tickets ("Forward"), or to purchase a Ticket Auction ("Auction") you must first register with My Cubs Tickets. To qualify for registration, you must be at least 18 years of age. By registering with My Cubs Tickets and accessing the Services, you are representing to us that you are at least 18 years of age. The Cubs or Tickets.com may suspend or terminate your My Cubs Tickets account if you are not qualified to use the Services.

2. Cubs Ticket Holders and Applicable Games. Not all Ticket account holders of record are authorized by the Cubs to use My Cubs Tickets to sell any Ticket on the StubHub Marketplace, to act on any Ticket through Ticket Forward or to purchase Ticket Auctions. In addition, the Cubs reserve the right to determine which Ticket account holders of record are eligible to utilize the Services and/or to use My Cubs Tickets to sell any Ticket on the StubHub Marketplace. Finally, only Tickets as designated by the Cubs from time to time may be listed from a My Cubs Tickets account to be sold on the StubHub Marketplace, sent through Ticket Forward or purchased in a Ticket Auction.

3. Accuracy of Information. You agree, and by using the Services you represent and warrant, that the information you provide to anyone in connection with your use of the Services (including, without limitation, the Cubs, MLB Advanced Media L.P. ("MLBAM") or StubHub) is true and accurate in all respects. None of Tickets.com, the Cubs, MLBAM or StubHub guarantees the truth or accuracy of any statements or representations made by My Cubs Tickets users. None of Tickets.com, the Cubs, MLBAM or StubHub will be liable or bear any responsibility for statements made by other My Cubs Tickets users.

4. Specific Terms Governing Selling and Buying Tickets Through My Cubs Tickets. If you sell a Ticket through the StubHub Marketplace, in addition to the Terms of Use specifically applicable to the StubHub Website and the StubHub Marketplace, you agree to be bound by the following terms:

A. Selling a Ticket.

    1. Non-Authorized Ticket Holders. Non-authorized Ticket account holders are not authorized to sell any Tickets on the StubHub Marketplace through My Cubs Tickets, even if such Ticket[s] were previously bought through the StubHub Marketplace.

    2. Seller and Buyer. You agree that when you use My Cubs Tickets to access the StubHub Marketplace in order to sell any Ticket, each of those transactions is between you and other My Cubs Tickets or StubHub users, as applicable, and that none of the Cubs, Tickets.com or MLBAM are parties to any such transaction. The sole purpose of the Cubs, Tickets.com and MLBAM is to provide the technology to facilitate the sale of your Tickets through your use of the Services. None of the Cubs, Tickets.com or MLBAM is acting as an agent for either the buyer or seller.

    3. Title to Sold Tickets. After you have posted a Ticket on the StubHub Marketplace from your My Cubs Tickets account and a buyer has elected to purchase that Ticket, title to the Ticket will automatically be transferred to the buyer. None of the Cubs, Tickets.com or MLBAM will ever take title to a Ticket during the course of a Ticket sale. A Ticket sale is complete when a buyer agrees to buy a Ticket that has been sent from the seller's My Cubs Tickets account to a buyer on the StubHub Marketplace. When a seller posts a Ticket for sale on the StubHub Marketplace, the seller is authorizing the Cubs and Tickets.com to invalidate the barcode imprinted on that Ticket and to issue a new Ticket to the buyer with a replacement barcode upon completion of the sale. The sales price of the Ticket and any other applicable fees and charges will be charged to the buyer's credit card upon completion of the sale. All Ticket sales are final and not revocable by the seller or the buyer.

    4. Seller's Risk of Loss. No assurances can be made that a buyer will complete a Ticket purchase. A seller bears all risk of loss if, for any reason, a buyer fails to make payment for any Ticket purchase.

    5. Timing of Payment. Upon completion of a sale on the StubHub Marketplace, a seller will receive a payment from StubHub in accordance with the terms of the StubHub User Agreement. Please refer to the StubHub Seller Q&A for more detail on timing of payments.

    6. No Use of Sold Tickets. After a Ticket is sold on the StubHub Marketplace and deactivated that Ticket will no longer be valid for any purpose, including admission to the game designated on that Ticket. A seller will receive one warning if any attempt is made to use such seller's Ticket after such Ticket has been deactivated. Any subsequent attempt to use any deactivated Ticket following such warning may result in the seller's permanent loss of eligibility to use My Cubs Tickets and the revocation of the seller's season Ticket account. None of the Cubs, Tickets.com, MLBAM or StubHub will be liable for any damage, loss or claim relating to anyone's use or attempted use of any deactivated Ticket.

    7. Cancelled Games. After a seller has sold a Ticket to a game, if that game is cancelled, StubHub will issue a refund to a buyer in accordance with the terms of the StubHub User Agreement. Please refer to the StubHub Buyer Q&A for more detail on refund policies.

B. Buying a Ticket.

    1. Ticket Seller. None of the Cubs, Tickets.com or MLBAM is the seller of any Ticket that you purchase through the StubHub Marketplace. The sole purpose of Tickets.com, the Cubs and MLBAM is to provide the technology to facilitate the sale of a Ticket to you through the StubHub Marketplace.

    2. Service and Other Charges. Any and all fees assessed to a Ticket purchase above the listed Ticket price on the StubHub Marketplace are at the discretion of StubHub and subject to change without notice. None of the Cubs, Tickets.com or MLBAM is acting as an agent for either the buyer or seller.

    3. Obligation to Complete Purchase. You agree that time is of the essence with respect to all Ticket purchases. All title, rights and obligations with respect to any Ticket will pass from the seller to you upon completion of a Ticket purchase. Any failure by you to pay for Ticket[s] purchased through the StubHub Marketplace may result in your permanent disqualification from further use of the StubHub Marketplace, the StubHub Website, or any of the other Services offered through My Cubs Tickets, at the Cub's discretion.

    4. Cancelled Games. If a game is cancelled after you complete your purchase of a Ticket to that game, StubHub will issue a refund to the buyer in accordance with the terms of the StubHub User Agreement. Please refer to the StubHub Buyer Q&A for more detail on refund policies.

    5. Rescheduled Games. If a game is rescheduled after you purchase a Ticket for that game, the Ticket that you purchased will remain valid and use of such Ticket will be subject to those policies applicable to Cubs Ticket holders generally, as the Cubs may amend such policies from time to time. You are not entitled to a refund or to otherwise retract your purchase of Ticket because the game was rescheduled and it is your responsibility to verify any changes to the information printed on the Ticket, including the date and time of the game.

5. Specific Terms Governing Use of Forward. If you forward a Ticket through Forward, you agree to be bound to the following terms. If you are a qualified My Cubs Tickets account holder of record and are forwarding a Ticket, you are referred to below as the “Sender”. If you are receiving a forwarded Ticket, you are referred to below as the “Recipient”.

  • Forwarding Tickets. If you are a Sender, you may forward one or more of your Tickets to a home game to any person, provided that the Recipient has a valid email address. You authorize the Cubs and Tickets.com to cancel and deactivate each Ticket that you forward and to reissue a valid Ticket to the Recipient.

  • Receiving Forwarded Tickets. If you are a Recipient, a new Ticket with a replacement barcode will be issued to you for any tickets forwarded to you. A Ticket that has been forwarded to you is only valid for the game imprinted on that Ticket (or the alternative game, solely in the event of a rescheduled game), and is only for your own personal use. Once a ticket has been forwarded, it cannot be forwarded again until it has been printed.

  • Use of Original Ticket After Forward. The Sender will receive one warning if any attempt is made to use such Sender's Ticket after such Ticket has been deactivated. Any subsequent attempts to use any deactivated Ticket following such warning may result in the permanent disqualification of the Sender from use of the Services and revocation of the Sender's season Ticket. None of the Cubs, Tickets.com or MLBAM will be liable for any damage, loss or claim relating to the use, or attempted use of any deactivated Ticket.

  • Rescheduled Games. In the event a game is postponed or rescheduled, any Recipient will be subject to those policies applicable to Cubs Ticket holders generally, as the Cubs may amend such policies from time to time. It is the Recipient's responsibility to verify any changes to the information printed on the Ticket, including the date and time of the game.

  • Cancelled Games. Ticket forwards for games that are cancelled will be reversed. Any Ticket that was forwarded to a Recipient for any cancelled game will be deactivated and will no longer be valid, and such Recipient will have no further rights in connection with that Ticket. Any forwarded Ticket for any cancelled game will be subject to those policies applicable to season Ticket holders generally, as such policies may be amended by the Cubs from time to time. You understand that Cubs games may be cancelled from time to time and that none of the Cubs, Tickets.com or MLBAM is responsible for any loss or damage in connection with such cancelled games.
  • 6. Specific Terms Governing Ticket Auction. Ticket Auction is a dynamic transaction environment which allows ticket buyers to purchase tickets at market value by auction. The ticket price is set based on the auction results. This Web site is hosted by, and the Season Seat Ticket Auction Services are facilitated by technology provided by, Tickets.com. Chicago Cubs Baseball Club, LLC ("Cubs") and Tickets.com are not affiliated with Chicago Board Options Exchange, Incorporated ("CBOE") or any of its subsidiaries or affiliates. CBOE is a naming rights sponsor of the section of seats named the "CBOE seats". CBOE is not involved in any manner in the conduct and operation of the CBOE Seats auction. If you bid on or purchase a Ticket through Ticket Auction you agree to be bound by the following terms:

  • By using the Ticket Auction Services, you also agree to adhere to any and all terms and conditions, rules, policies, regulations and directions of Tickets.com as such may be amended from time to time. In addition, you agree to adhere to any and all terms and conditions, rules and policies (a) printed on admission tickets to games played by the Cubs and all other laws, rules, and policies applicable to events at Wrigley Field; (b) the terms, conditions and policies set forth in the Ticket Auction Frequently Asked Questions; and (c) the Terms of Use and Privacy Policy applicable to this Web site, each of which is incorporated as part of this Agreement by this reference. Specifically, you agree to use the Ticket Auction Services subject to and in accordance with the following terms and conditions and, where applicable, you represent the same to be true:

  • You understand and agree tickets offered for sale via Ticket Auction are being offered for sale by the Chicago Cubs. You are paying market value for these tickets. You are not obligated to purchase any tickets until you click "I agree" and have provided your credit card billing information.

  • Availability of Tickets. Tickets sold in the Ticket Auction are determined by the Cubs. You are bidding on the right to purchase seats in the locations and combinations noted in the auction, as determined by the Cubs. No other combinations or locations are available as part of this auction and no other rights are granted.

  • Ticket price and other charges. When you buy a ticket through Ticket Auction, the ticket price is market value of the ticket as determined by the winning auction bid. All charges will be collected at the time the sale transaction is complete.

  • Registration and Payment. To participate in the auction, you must register on the auction Web site and provide a valid credit card (name on card, card number, expiration date, etc.). The credit card will not be billed until the end of the auction. The card provided by the Auction Winner will be billed at the close of the auction.

  • Reserve. If an auction has a reserve price (the "Reserve Price") and no bidder bids higher than the specified reserve amount, the tickets will not be sold and there will be no Auction Winner.

  • Determining the winning bid.. At the close of the auction period, the individual placing the highest bid will be deemed to be the winner ("Auction Winner").

  • Increasing your bid. If another bidder places a bid higher than yours, if you wish to continue participating in the auction, you must return to this site and submit a new bid at a price higher than the amount shown as the current high bid. This auction does not use "proxy bidding" or any other automated method of bidding or allow the auction system to automatically place higher bids for you.

  • All bids are final. Once you place a bid, you cannot cancel, retrieve or revise it.

  • Last-minute bidding. Placing a high bid in the closing seconds of an auction listing is possible. All bids placed before a listing ends are valid - even if they're placed one second before the listing ends.

  • Breaking a tie. When you submit a bid, the date and time your bid was submitted are recorded. At the close of an auction, if two or more bidders bid the same amount, the bidder who placed his or her bid first will be the winner. During the auction period, each time you bid, the date and time of your bid are recorded and your information is updated. The dates and times of your previous bids are no longer applicable.

  • Determination of a winning bid is final and binding. Tickets.com and/or Cubs reserve the right to refuse to accept any bids, including a bid which would otherwise be deemed to be a winning bid, at any time and for any reason. The Cubs reserve the right to sell or not sell a ticket for admission to any person(s) to the full extent permitted by law.

  • Payment. The Auction Winner is responsible for payment in full of the final bid price, applicable service charges and taxes. Payment in full must be made by credit card and must be received by the Cubs no later than five business days after the close of the auction. Payment by credit card may be made by calling the Cubs' box office at 1-800-THE-CUBS. Payment by certified check may be hand delivered to the Wrigley Field ticket office or sent via overnight mail to Cubs Season Seat Ticket Auction, c/o Chicago Cubs, 1060 W. Addison, Chicago, IL 60613. If payment is not received as required, the Cubs may void the auction and/or may elect to sell the tickets to others.

  • Obligation to complete purchase. You agree time is of the essence with respect to all ticket purchases. Tickets will be sent to you only upon receipt by the Cubs of the payment required in these terms and conditions. Any failure by you to pay for a ticket and the applicable service charges and taxes may result in forfeit of rights to use any Cubs tickets purchased or bid on during the auction and in your permanent disqualification from further use of Ticket Auction all in addition to any other remedies available to the Cubs and the other Released Parties.

  • Payment problems. If there is a problem processing your payment, then as a Customer Service may attempt to contact you at the phone number(s) on your account. You may provide a new method of payment. If the Cubs are not able to contact you at the phone number on your account within 24 hours of the close of the auction and is not otherwise able to resolve the payment issue, your transaction may be cancelled, the auction may be voided.

  • Authorization to charge credit card. By placing a bid, you agree if you are the successful bidder, we may charge your credit card for auction total amount. We will not contact you prior to charging your credit card. Your card will be charged automatically, immediately following the close of the auction.

  • Cancelled and rescheduled games. After you have purchased tickets, the Cubs standard policies and procedures applicable to ticket holders shall apply. However, if there is a conflict between these terms and conditions and policies or procedures applicable to ticket holders, then these terms and conditions shall apply. You understand Cubs games may be cancelled from time to time and the Released Parties are not responsible for any loss or damage in connection with cancelled games, provided however in the event a cancelled game is not rescheduled, you will receive a refund.

  • Cancellation of auction. The Cubs reserve the right to cancel an auction without cost or penalty at any time, up to the time an auction closes.

  • No liability for interruption of auction system. Neither the Cubs, Tickets.com, or MLBAM will be responsible for any auction which fails or is cancelled as a result of this site becoming inoperable, your inability to access this site, or any system fault or failure which may result in your bid not being received in a timely manner. The Cubs reserve the right to terminate any auction without cost or penalty at any time if the fairness or process for the auction has been compromised.

  • 7. Termination of Participation.
